CANCELLATION AND REFUND POLICY

1. INTRODUCTION AND PARTIES

This policy governs the cancellation, refund, and withdrawal right processes for digital services (Subscriptions and Production Packages) provided by MERS YAZILIM VE TEKNOLOJİ HİZMETLERİ LİMİTED ŞİRKETİ ("Digitable").

Digitable uses payment infrastructures of different statuses depending on the user's region:

  • Turkey: iyzico Ödeme Hizmetleri A.Ş. payment infrastructure is used. The Vendor is Digitable.
  • Global: Paddle.com Market Limited is used. Paddle acts as the "Merchant of Record" (Authorized Reseller). For global transactions, Paddle's terms of sale and this policy apply together.

2. DEFINITIONS AND SCOPE

For a clear understanding of refund processes, unit types and services are categorized as follows:

Subscription Units: Usage rights renewed monthly within the scope of a monthly or annual plan.

Production Packages (Top-up): One-time purchased packages independent of the subscription that remain valid as long as the user account is active.

Welcome Units: Free units provided within the trial version. Since they have no monetary value, they are not subject to refund.

3. WITHDRAWAL RIGHT AND REFUND CONDITIONS

The user has accepted immediate delivery of the digital service by checking the "Instant Performance Consent" checkbox during checkout. Refund conditions are determined by the "Consumption Status" of the service:

A. Full Refund (If Service Not Used)

Within 14 days from the purchase date, an unconditional 100% refund is provided if the following conditions are met:

  • For Subscriptions: No AI units included in the plan have been used.
  • For Production Packages: Not even a single (1) unit from the purchased package has been spent.

B. Refund Rejection (If Service Consumed)

Due to the nature of digital services and high processing costs (GPU/Server);

Usage Initiation: When even 1 (one) AI unit is used by pressing the "Generate" button after purchase, the service is considered fully performed.

Legal Consequence: In this case, the withdrawal right expires and no refund is provided: for users in Turkey pursuant to Article 15/ğ of the Distance Contracts Regulation; for global users pursuant to Article 16/m of the EU Consumer Rights Directive (CRD).

c) Production Packages (Unit Top-up)

Production packages are one-time purchased additional unit packages independent of the subscription:

  • Unused units from production packages can be refunded within 14 days of purchase, provided no units from the package have been used.
  • If any units from the package have been partially used, no refund is provided for the remaining units.

4. SUBSCRIPTION CANCELLATION AND RENEWAL

Cancellation Process: Users can cancel their subscriptions at any time via the dashboard. Cancellation stops the next payment period; it does not provide a retroactive refund.

Access: For cancelled subscriptions, the user can continue to use their remaining units until the end of the paid period.

5. SPECIAL CASES AND CHARGEBACK

A. Technical Impossibility and Partial Refund

In the event that the service is permanently terminated or uninterrupted service cannot be provided for more than 72 hours due to a technical issue caused by Digitable;

  • Monthly Plans: The full monthly fee is refunded.
  • Annual Plans: A pro-rata refund is issued for the remaining period where the service could not be provided.

Refund processing times may vary depending on the payment provider (iyzico or Paddle) and your bank.

B. Chargeback Policy

If the user initiates a Chargeback/Dispute process through their bank despite having used the service and this being confirmed by system records:

  • Digitable submits the user's transaction logs (IP address, generation history, consent checkbox records) as evidence to the payment institution and bank.
  • For transactions where usage is confirmed in system records, processing fees and legal expenses arising from the unjustified dispute may be charged back to the user and the user's account will be permanently closed.

6. CONTACT, OBJECTION AND PROCESS

Refund requests should be submitted to [email protected] with the order number.

Objection Right: The user has the right to object to system records if a refund request is rejected on grounds of "Unit Usage." Objections are reviewed by the technical team within 5 business days and the final result is communicated along with detailed log records.

Paddle Transactions: For global refunds, Paddle's review mechanism takes precedence. Digitable triggers approved refunds through the Paddle panel.

Timeline: Approved refunds are reflected on the card within 7-14 business days.
