Buyer Information

Buyer information is the information declared by the buyer during the service purchase process. The buyer is responsible for the accuracy of this information.

2. SUBJECT OF THE AGREEMENT

The subject of this agreement is the determination of the rights and obligations of the parties regarding the sale of the Digitable restaurant management system service offered by the Seller to the Buyer electronically, in accordance with the provisions of Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation.

3. ESSENTIAL CHARACTERISTICS OF THE SERVICE

Digitable is a cloud-based restaurant management system for food and beverage businesses. The main features of the service are:

  • Digital menu creation, editing, and publishing
  • QR code table ordering system
  • Real-time order tracking and station management
  • AI-powered analytics, reporting, and business management
  • Multi-language support for serving international customers
  • AI-powered image generation for products
  • AI-powered promotional video creation
  • AI-powered menu translation and text content generation

The detailed scope and features of the service are determined by the selected subscription plan. Plan details and limits are published on the Platform's pricing page.

4. SERVICE PRICE AND PAYMENT INFORMATION

The service fee is determined according to the selected subscription plan, and the total price including all taxes is clearly shown to the Buyer during the purchase process.

  • For users in Turkey, payment transactions are processed through iyzico Ödeme Hizmetleri A.Ş. Payment collection, invoicing, and financial compliance processes are managed by iyzico.:
  • For users outside Turkey, payment transactions are processed through Paddle.com Market Limited. Paddle, as the "Merchant of Record", is responsible for international payment collection, invoicing, taxes, and financial compliance processes.:

Price Change Conditions:

  1. Monthly Plans: Price changes are notified at least 30 days before the next billing period. The customer can cancel their subscription before the new price takes effect.
  2. Annual Plans: Price changes apply from the next renewal period. The current annual period continues at the existing price.
  3. Production Packages: Prices of production packages may change at any time. Purchased packages are not affected by price changes.

5. DELIVERY / PERFORMANCE METHOD

Digitable is a digital service and does not require physical delivery. Instant access to the service is provided upon confirmation of payment. After the user account is created, all service features are activated according to the selected plan.

AI units included in the subscription plan are assigned to the customer's account upon activation. Production package units are assigned immediately upon payment confirmation.

6. RIGHT OF WITHDRAWAL

The Buyer has the right to withdraw from the agreement within 14 (fourteen) days from the date of service purchase without providing any reason and without paying any penalty.

The Buyer wishing to exercise the right of withdrawal must submit a written notification to [email protected] within this period. The payment will be refunded within 14 days at the latest from the receipt of the withdrawal notification, using the appropriate payment method.

Immediate Performance Consent: By accepting the Terms of Use during purchase and consenting to immediate activation of the service, the buyer acknowledges that the right of withdrawal may be limited.

However, this limitation does not apply if the digital content or service has not been started or no units have been used. In such cases, the buyer can exercise the right of withdrawal within 14 days.

7. REFUND AND CANCELLATION CONDITIONS

Cancellation and refund conditions are as follows:

  • Subscription Cancellation: The buyer can cancel their subscription at any time. Cancellation takes effect at the end of the current billing period.
  • Refund for Unused Period: For annual subscriptions, a pro-rata refund may be issued for the unused period upon early cancellation.
  • Unit Refund: Unused units from production packages can be refunded within 14 days of purchase, provided no units have been used.
  • Detailed Conditions: Detailed cancellation and refund conditions are regulated in the Cancellation and Refund Policy.

8. RESPONSIBILITY

The Seller is responsible for providing the service in accordance with the agreement. In case of technical disruptions in accessing the service, the Seller shall make reasonable efforts to resolve the issue within a reasonable time. The Seller cannot be held responsible for failure to provide the service due to force majeure (natural disasters, war, legal regulations, etc.).

The seller does not guarantee uninterrupted or error-free operation of the service. Technical maintenance and updates may cause temporary interruptions.

The total liability of the seller is limited to the service fee paid by the buyer in the last 12 months.

The accuracy, currency, and legality of content uploaded or created by the buyer on the Platform is exclusively the buyer's responsibility.

9. REFERENCE TO OTHER POLICIES

This Agreement is supplemented by and should be read together with the Terms of Use, Privacy Policy, Cookie Policy, Content Policy, and Cancellation and Refund Policy published on the Platform. The current texts of these policies are accessible on the Platform.

9. DISPUTE RESOLUTION

For disputes arising from this agreement, Consumer Arbitration Committees are authorized within the monetary limits determined by the Ministry of Trade, and Consumer Courts are authorized for disputes exceeding these limits.

The Buyer may file their application with the Consumer Arbitration Committee or Consumer Court at their place of residence or where the consumer transaction took place.

10. EFFECTIVE DATE

This agreement comes into effect when the Buyer purchases the service and the payment is confirmed. The Buyer declares that they have read and accepted all terms of this agreement before completing the purchase.
